Per the FEMA levee criteria, some of the requirements for an approved levee
system include the following: the flood protection levee must be constructed with a
minimum of 3 to 3.5 feet of freeboard (additional elevation above the loo-year water
surface elevation), prepare an embankment stability analysis, conduct a seepage analysis
for the embankment, determine the loo-year flood hydrograph against the embankment,
determine the loadings on the levee, conduct a stability analysis and a foundation bearing
strength analysis for each soil type, determine settlement of the levee crest, prepare an
internal drainage analysis, etc. Additionally, an operations and maintenance manual will
need to be prepared and approved by FEMA which will include the acceptance of
responsibility for operations and maintenance of the levee in perpetuity by a state,
regional or local government agency. According to FEMA representatives, the
University could be considered a state agency for this purpose only if they hold
ownership of the Property.

-25-
