<br />WHEREAS, said report dated July 1994 includes approximate floodplain information for those e <br />portions of the Central Basin and the East Basin within the corporate limits of the Town of Ordway, <br />as they were in July 1994; and <br /> <br />WHEREAS, the Colorado Water Conservation Board, as requested by the Town of Ordway, by <br />Resolution No. 94-367, adopted on July 19, 1994, approved and designated the floodplains described <br />in said report; and <br /> <br />WHEREAS, said new report dated June 1987 contains approximate floodplain information for <br />the areas shown as approximate floodplain in Resolution No. 94-367 that is consistent with the <br />approximate floodplain information contained in Resolution No. 94-367; and <br /> <br />WHEREAS, said new report dated June 1987 contains approximate floodplain information for <br />areas upstream of the areas shown as approximllte floodplain in Resolution No. 94-367; and <br /> <br />WHEREAS, the Town of Ordway, Colorado, has requested the Colorado Water Conservation <br />Board to designate and approve the floodplains set forth in the aforesaid new report; and <br /> <br />WHEREAS, the Town of Ordway, Colorado, has not requested the Colorado Water Conservation <br />Board to rescind any portion of Resolution No. 94-367; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water. _ <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and _ <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve stoflll or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said report meets all of the requirements for approximate <br />information listed under the Board's "Rules arld Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); <br /> <br />WHEREAS, the staff finds that there is nO need to rescind any portion of Resolution No. 94-367 <br />in order to designate said new report; and <br /> <br />WHEREAS, the Town of Ordway will regulate those areas which are not shown as being in the <br />approximate floodplain in Resolution No. 94-367 but which are shown as being in the approximate <br />floodplain in said new report in the same manner that the Town of Ordway regulates those areas which <br />are shown as being in the approximate floodplain in Resolution No. 94-367; <br /> <br />e <br /> <br />2 <br />
