<br />J <br /> <br />FPR 212/ <br /> <br />) <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />March 3, 1983 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a floodplain information report entitled <br />"McClellands and Mail Creek, Major Drainageway Plan," dated <br />December, 1980, has been prepared by the Cornell Consult ing <br />Company and John S. Griffith, P.E., at the request of the City of <br />Fort Collins; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and informat ion' for the storm and floodwater ' runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the City of Fort Collins has requested the Colorado <br />Water Conservation Board to designate and approve the floodplain <br />areas as set forth in the aforesaid report; and <br /> <br />,WHEREAS, ,Sect.iqp '.3.7-60-106 ( 1) , Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damqges therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said ,report and <br />does hereby recommend to the Colorado Water Conservat ion Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood) <br />as described by the floodwater surface elevations and profiles in <br />said reportl ' <br /> <br />) <br /> <br />128 <br />res/212 <br />
