Either policy shall remain in <br />effect for the duration of the contract and for at least <br />years beyond the completion and acceptance of the facilitY:-- <br />The ENGINEER shall be responsible for all claims, -damages, <br />losses or expenses, including attorney's fees, arising out of <br />or resulting from the performance of Professional Services <br />contemplated in this contract, provided that any such claim, <br />damage, loss or expense is attributable to bodily injury, or <br />death, or to injury to or destruction of tangible property, or <br />to failures of the structure or facility, including the loss of <br />use r~sulting therefrom, and is caused, in whole or in part, by <br />any negligent act, error or omission of the ENGINEER, any <br />consultant or associate thereof, anyone directly or indirectly <br />employed by the ENGINEER. The ENGINEER shall submit a <br />Certificate of Insurance verifying said coverage at the signing <br />of this agreement and also any Notices of Renewals of said <br />policy as they occur. <br />23. The services called for in the- Section A-I and A-2 of this <br />Agreement shall be completed and the report submitted within <br />calendar days from the date of authorization to <br />proceed. After acceptance by the OWNER and CWCB of the <br />Preliminary Engineerifig Report and upon written authorization <br />from the OWNER, the ENGINEER will complete final plans, <br />specifications, and contract documents and submit for approval <br />of the OWNER, CWCB, and all State regulatory agencies within <br />calendar days from the date of authorizaton unless <br />otherwise agreed to by both parties. <br /> <br />If the above is not accomplished within the time period <br />specified, this Agreement may be terminated by the OWNER. The <br />time for completion will be extended by the OWNER for a <br />reasonable time if completion is delayed due to unforeseeable <br />causes beyond the control and without the fault or negligence <br />of the ENGINEER. <br /> <br />SECTION B - COMPENSATION FOR ENGINEERING SERVICES <br /> <br />1. The OWNER shall compensate the ENGINEER for preliminary <br />engineering services in the sum of <br />nollars ($ ) after the review and approval of the <br />preliminary engineering repo~t by the OWNER and CWCB. <br /> <br />2.
