Waivel" Ol" Delav of Enforcement. of Rules DV_ the State [neins@l" <br /> <br />The State Engineer may waive or delay the enforcellOnt of any of <br />the responsibilities of dam owners under the foregoing rules in <br />particular cases If in his judgement dam safety will not be <br />unreasonably Impaired and the circumstances of the Individual case so <br />warrants. Such circumstances may include, but are not limited to, the <br />benefits which would be realized by full enforcement, the cost or <br />difficulty of complete compliance, the owner's good faith efforts to <br />comply, the expected remaining life of the structure, and the impacts <br />of beneficial use of water in Colorado. <br /> <br />Rule 21. Rules bv Reference <br /> <br />Certified copies of the complete text of the materials Incorporated by <br />reference in these rules shall be maintained by the Office of the <br />State Engineer and shall be available for public Inspection .durlng <br />regular business hours.. Certified copies of the material incorporated <br />shall be provlded.at cost upon request. Severabilitv <br /> <br />If any portion of these Rules and Regulations for Dam Safety and <br />Dam Construction is found to be invalid, the remaining portion of the <br />rules shall remain in force. <br /> <br />Rule 23. Revision <br /> <br />The State Engineer may revise these Rules and Regulations for Dam <br />Safety and Dam Construction in accordance with Section 24.4-103, <br /> <br />- 49 - <br />
