(,\-.t--" <br /> <br />RESPONSIBILITIES <br /> <br />The Federal Emergency Management Agency (FEMA) does comply, as a Federal funding <br />agency, with the National Environmental Policy Act (NEPA) PL 91-190 which was passed by <br />the Congress of the United States in 1970. Likewise, FEMA adheres to the regulations and <br />guidance issued by the Council on Environmental Quality (CEQ), which was created by that Act. <br /> <br />The following are two sections ofFEMA's regulations that pertain to the funding ofHMGP and <br />P A projects relative to the implementation ofNEP A. <br /> <br />44 CFR 10.4 (a) POLICY <br />FEMA shall act with care to assure that, in carrying out its responsibilities, including disaster planning, response and <br />recovery and hazard Iilitigation and flood insurance, it does so in-a manner consistent with DlItional environmental <br />policies. Care shall be taken to assure, cona<tent with other considerations of natiottal policy, that all practical <br />means and measures are used to protect, restore, and ""h.n~ the quality of the environmeDt, to avoid or minimize <br />adverse cnvirotom-.1 consequences. <br /> <br />." <br /> <br />FEMA shall: <br />(1) Assess environmental consequences of FEMA actions; <br />(2) Use a systematic, intcIdisciplinary approach that will ensure the integrated use of the naturlll and social sciences, <br />and environmental considerations, in planning and decision making where there is a polenlial for significant <br />enviromn"""'l impact; <br />(3) Ensure that presently unmeasured environmental amenities are considered in the decision making process; <br />(4) Consider reasonable altcmalives to recommended courses of action in any proposal that involves conflicts <br />couccming altcmalives uses of resources; <br />(5) Make available to StaIcs, counties, municipalities, institutions, and individuals advice and information useful in <br />restoring, maintaiDing, and cnbancing the quality of the enviromncnt. <br /> <br />44 CFR 10.7 (c) (2) RESPONSIBILITIES OF THE APPLICANT <br />(1) Conlac:t FEMA Region vm as early as possible in the planning process for guidance on the scope and level of <br />cnvironmcntal infonnation required to be submitted in support of their application; <br />(2) Conduct any studies which are deemed Il--'''Y and appropriate by FEMA to determine the impact of the <br />proposed action on the human environment; <br />(3) Consult with appropriate Federal, regional, Stale, and local agencies and other potcntially interested parties <br />during pl"lim;",,"Y planning stages to ensure that all cnviromncnta1 factors are identified; <br />(4) Submit applications for all Federal, regional, Stale, and local approvals as early as possible in the planning <br />process; . <br />(5) Notify FEMA Region vm as early as possible of all other Federal, regional, State, local. and IDdian tribal <br />actions required for project completion so that FEMA may coordinate all Federal environm'1ll.1 reviews; and <br />(6) Notify FEMA Region vm of all known parties potentially aft"ectcd by or interested in the proposed action. <br /> <br />t <br /> <br />5 <br />
