POA <br /> <br />STATE OF COLORADO <br />CONSULTANT AGREEMENT <br /> <br />PROJECT NUMBER: <br /> <br />THIS AGREEMENT made this 8th day of December, in the year 1997 by and between the State of <br />Colorado, acting by and through the Colorado Water Conservation Board, hereinafter referred to as the <br />Principal Representative, and Icon Enaineerincl. Inc.. a Colorado Corporation, hereinafter referred to as the <br />Consultant. <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made <br />available, and a sufficient unencumbered balance thereof remains available for payment in Fund Number <br />100, Org, Number 5500, Appropriation PD1, Program WTRC, GBL HAZM, and Contract Number'" j:)"f) I" <br />and <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with <br />appropriate agencies; and <br /> <br />WHEREAS, the Principal Representative intends to comDlete the City of Ste~ina & Loaan County, Colorado <br />Flood Hazard Mitiaation Feasibility Study: hereinafter called the Project; and <br /> <br />WHEREAS, the Consultant was selected and determined to be the most qualified, and fees negotiated in <br />accordance with the provisions of C,R.S. ~24-30-1401 et seq; and <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />ARTICLE 1. SCOPE OF WORK <br /> <br />The Consultant, in consideration of State's promises hereinafter made, promises to perform and accomplish <br />all the work and services proposed, and in accordance with the terms and conditions set forth in the scope of <br />work description and proposal dated December 3, 1997, which documents are attached hereto and made a <br />part hereof by reference as Exhibit "A", Consultant shall undertake and perform the necessary work and <br />services as is customarily done in the professional practice of architecture/engineering/consulting in the <br />community for undertakings of similar character, scope and magnitude, <br /> <br />ARTICLE 2. <br /> <br />COMPENSATION <br /> <br />In consideration for the performance of the said work and services, Principal Representative agrees to pay to <br />Consultant fees and charges not to exceed Fifteen thousand one hundred fifty dollars ($15.150,00), The total <br />fees and expenses shall be payable upon completion of the work and services and acceptance by the <br />Principal Representative. Payment shall be made against Application for Payment (State of Colorado Form <br />SC-7, 1 ), submitted in triplicate. <br /> <br />ARTICLE 3. <br /> <br />CONSULTANT CERTIFICATION <br /> <br />In accordance with Title ~24-30-1404 (1), C.R.S" the Consultant has executed a certificate, which is attached <br />hereto and made a part hereof by reference as Exhibit "C", stating that wage rates (Exhibit "B") and other <br />factual unit costs supporting the compensation paid by the State for these professional services are accurate, <br />complete, and current The original contract price and any additions thereto shall be adjusted to exclude any <br />significant sums by which the State determines the contract price has been increased due to inaccurate, <br />
