<br />FPR 210 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sher~an Street <br />Denver, Colorado 80203 <br /> <br />March :3, 1983 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, Town of <br />paonia, Colorado, Delta County,'; wh'ich includes floodplain <br />information and data for Minnesota Creek and North Fork Gunnison <br />River, dated September 16, 1982, has been prepared by MSM <br />Consultants, Inc., ,under coritract with the Federal Emergency' <br />Management Agency; and <br /> <br />WHEREAS, said report descrtbes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />) <br /> <br />WHEREAS, the Town of paonia has requested the Colorado Water <br />Conservation Board to designate and approve the floodplain areas <br />as set forth in the aforesaid report; and <br /> <br />, WHERE~S, 'Section" 37-60-106 ( 1 ) , Colorado Revised Statutes <br />1973,'requiies the'Coloradowater"Conservation ,Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30.28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations' for land uses on or <br />along any storm or floodwater rllnoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106( 1 )(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the Colo,rado Water Conservation Board <br />that the Board designate and a!?prove as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood ) <br />as described by the floodwater surface elevations and profiles in <br />said report; <br /> <br />128 <br />res/210 <br />
