<br />LOCAL REQUEST FOR DESIGNATION <br />,WHEREAS, Arapahoe County, Colorado has requested that the Colorado Water <br />Conservation Board take formal action on the floodplain information contained in said report with <br />included maps dated August 1977; and , <br /> <br />c.R.S AUTHORITY <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff chanriel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />'COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br />WHEREAS, the approximate floodplain information in said report with included maps for <br />stream reaches in Arapahoe County as listed in Table 2 was the best regulatory floodplain <br />information at the time of the study but did not meet the Board's "Rules and Regulations for the <br />Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1) during the time in which said report was effective; and <br /> <br />WHEREAS" the Colorado Water Conservation Board produced a report entitled <br />"Guidelines for Determining 1 OO-year Flood Flows for Approximate Floodplains in Colorado" <br />(Guidelines) that provides basic hydrology information for certain streams within Arapahoe <br />County and other portions of the state; and <br /> <br />WHEREAS, the availability of the hydrology Guidelines, 'as they apply to certain <br />approximate floodplain reaches in Arapahoe County, now provide a means for those certain <br />floodplain reaches to meet the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the detailed floodplain information in said report with included maps for <br />stream reaches in Arapahoe County as listed in Table 3 meets the ':requirements for detailed <br />floodplain information as listed in the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408- <br />I), based on a cursory review only by the CWCB staff; and ' <br /> <br />WHEREAS, the approximate and detailed floodplain information contained in said report <br />with included maps has been superseded by more current Flood Insurance Studies or floodplain <br /> <br />3 <br />
