<br />WHEREAS, the detailed floodplain information in said report dated September.] 977 for those <br />stream reaches listed in Tab]e 3, attached hereto and by this reference incorporated herein,is consistent <br />with the detailed information contained in FPR No. ]20, for those stream reaches listed in Table 3; and <br /> <br />e <br /> <br />WHEREAS, the detailed information in said report dated September ]977 for those stream <br />reaches listed in Table 4, attached hereto and by this reference incorporated herein, has not been <br />designated and approved by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, the Town of PagosaSprings and Archuleta County, Colorado, have requested the <br />Colorado Water Conservation Board to designate and approve the floodplains set forth in the report <br />dated September 1977; and <br /> <br />WHEREAS, Section 37-60-]06(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said neW report meets all of the requirements for detailed <br />information listed under the Board's "Rules arld Regulations for the Designation and Approval of a <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); ,., <br /> <br />'" <br /> <br />NOW, THEREFORE, BE IT RESOL VEl) by the Colorado Water Conservation Board in regular <br />meeting assembled in Fort Morgan, Colorado, this 26th day of May, 1994, that it does hereby designate <br />and approve as detailed floodplain information tile 100-year floodplains as described by the floodwater <br />surface elevations and profiles in said report, dated February 1977 and listed in Tables 3 and 4; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a certified <br />copy of this resolution to the Town ofPagosa Springs; the Board of County Commissioners of Archuleta <br />County; the Colorado Office of Emergency Management; the U.S. Soil Conservation Service; and the <br />Federal Emergency Management Agency. <br /> <br />CERTIFICATE <br /> <br />I certify that the foregoing is a true and correct copy of a resolution adopted by a majority vote <br />of the members of the Colorado Water Conservation Board in regular session assembled at Fort Morgan, <br />Colorado, on the 26th day of May, 1994, at which a quorum was present, <br /> <br />q~(i A <br /> <br />Darles c.
