<br />-5- <br /> <br />. <br /> <br />If detailed maps of the "lOa year" floodplain are not available, <br /> <br />states and communities sometimes manage and regulate those areas <br /> <br />which have been flooded by past flood or which the community has <br /> <br />reason to expect to be flood-prone, based on best available data <br /> <br />such as soil maps. (See Chapters 1,2, 6, and 8.) <br /> <br />A "regu 1 a tory wetland" is defi ned by the U. S. Army Corps of <br /> <br />Engineers for the Federal 404 permit program to include: <br /> <br />The term wetlands means those areas that are included or <br />saturated by surface or ground water at a frequency or <br />duration sufficient to support, and that under normal <br />circumstances do support a prevalence of vegetation <br />typically adapted for life in saturated conditions. <br />Wetlands generally include swamps, marshes, bogs and <br />similar areas. <br /> <br />Definitions contained in state and local regulations are <br /> <br />similar. However, unvegetated areas are addressed by some defini- <br /> <br />tions. (See Chapters 1, 2, 6 and 9.) <br /> <br />. <br /> <br />8. Q. What are the basic regulatory techniques available to communities <br />managing and regulating their floodplains and wetlands? <br />A. Local and state programs utilize five types of legal measures. <br />Floodplain Zoning specifies the location, usage, and density <br />of uses including fills and structures. Development may be pro- <br />hibited or carefully controlled in wetland and floodplain areas. <br />Building Codes regulate the design, elevation, and construction <br />materials of new structures. Generally, structures must be elevated <br />or floodproofed to the lOa-year flood protection elevation. <br />Subdivision Regulations control the process of subdividing a <br />large parcel of land into smaller house lots. As a condition to <br />subdivision approval, the community may require a developer to <br />refrain from building in hazardous areas and to install drainage <br />facil ities. <br />Sanitary and Well Codes establish minimum standards for on-site <br />waste disposal and water supply. They may prohibit such facilities <br />in areas of high ground water and flood hazards. <br /> <br />. <br />
