ANY CIRCULATION OR DISTRIBUTION TO <br />PERSONS OUTSIDE THE EMPLOY OF THE CLIENT MAY WAIVE THE <br />PRIVILEGE. <br /> <br />TO: <br /> <br />The Colorado Water Conservation Board <br /> <br />FROM: <br /> <br />Lynn Obernyer <br />Linda Bassi <br /> <br />RE: <br /> <br />The Colorado Water Conservation Board's authority to <br />grant various requests for use of portions of the South <br />Platte Channelization Project <br /> <br />The Colorado Water Conservation Board ("Board") has received <br />ten requests from different types of entities for the Board to <br />grant them use of portions of the South Platte Channelization <br />Project ("the Project") for four types of uses: <br /> <br />A. governmental/quasi-governmental requests for <br />easements <br />B. private requests for storm drainage easements <br />C. private requests for easement for access road <br />D. private request for easement for a deck and volley- <br />ball court <br /> <br />The Board has requested an analysis of its authority to grant <br />each type of request as well as the ability to grant licenses and <br />permits. <br /> <br />QUESTION 1: Does the Board have the authority to grant all <br />requests? <br /> <br />RESPONSE 1: The provisions of ~37-60-119(2) 15 C.R.S. <br />
