Consideration for Easements Granted by the CWCB

Attached for your review are excerpts from the State of
Colorado Contracts and Procurement Code Manual ("Manual"), dated
June 9, 1988, that pertain to consideration for easements granted
by the State. The Manual is the predecessor to the contracts
manual currently in use (Jan Illian has a copy). The current
manual does not contain any information regarding easements and
consideration for easements. I spoke with C. Richard Pennington,
who obtained the Manual from David Kaye. He told me that the
information in the Manual is still valid. The current manual was
compiled to update information and to edit out material that was
not of general applicability. The easement section was edited out
because very few state agencies grant easements.

The form we have adopted for granting easements contains all
of the provisions of the form in the Manual. The Land Use
Consideration Statement might be a useful way to document your
calculation of the consideration for easements granted by the CWCB.
However, the form would need to be revised to delete "right-of-way"
and replace it with "easement."
