Easements and Rights-of-Way: In the event that part or all of a proposed <br />development is traversed by any water course channel, stream or creek, <br />gulch, or other natural drainage channel classified as a "major channel," <br />(any channel or drainageway with 100 cfs or greater flows in a major <br />storm or any channel with a designated floodplain on the City's Official <br />Flood Hazard Map) the subdivider shall dedicate adequate easements for <br />storm drainage and maintenance access purposes. <br /> <br />Easements are also to be deeded for the purposes of operation, repair, <br />alteration, and maintenance of the storm water management system in areas <br />composed of single family detached dwellings and two-family dwellings or <br />in other developments when the City has accepted maintenance and operation <br />responsiblities. These easements shall cover the outlet structure, storm <br />water pipes, detention area berms, and other parts of the storm water <br />management system which the City deems shall be granted to the City. <br /> <br />All developments which have publicly owned easements shall provide cove- <br />nants running with the land stating that no buildings, fills, excava- <br />tions, structures, fences, or other alterations shall be constructed <br />within a publicly owned easement without the express written consent of <br />the City. <br /> <br />I. "As Built" Drainage Plan: A professional engineer retained by the devel- <br />oper shall inspect the construction of the improvements for the purpose <br />of determining conformance wi tl1 the approved Drainage Plan Sheet. This <br />inspection shall include verification that the following conform reason- <br />ably to the drainage plan: <br /> <br />Finished floor elevations <br />Sizes, grades, locations, and elevations of drainage structures, <br />cl1annels, pipes, etc. <br />Location of basin boundaries <br />Detention pond volumes <br />Facilities appear to be constructed in a workmanlike manner and <br />functional <br /> <br />Any significant deviations from <br />annotated on the "As-built" plans. <br />exceed the following tolerances: <br /> <br />the approved drainage plan shall be <br />Significant deviations are those that <br /> <br />elevations <br />slopes greater of <br />distances <br />volumes <br /> <br />:!: 0.1 ft <br />:!: 5% but not less than .OOOS ft/ft. <br />:!: 1.0% <br />:!: 5.0% <br />
