<br />. <br /> <br />such lower rate shall become effective as of!the date the higher rate was <br />placed in effect on an interim basis by the ~ssistant Secretary, and the <br />amount of the refund will be the overpayment!on all transactions, that is, <br />the difference between the amount paid for t~e transaction and the amount <br />that would have been paid under the Substitute Rate, unless the FERC deter- <br />mines that there will be no refund because the administrative cost of a <br />refund would exceed the amount to be refunded. In the case covered by the <br />proviso in Subsection (d) the amount of the refund is determined by the <br />FERC. In both cases, the amount of interest' on the refund will be <br />determined by the FERC. <br /> <br />, <br />(g) A rate confirmed and approved by ~he FERC on a final basis shall <br />remain in effect for such period or periods as the FERC may provide or until <br />the Assistant Secretary places a new Provisibnal Rate into effect; Provided, <br />That the Assistant Secretary may extend the rate on an interim basis beyond <br />the period specified by the FERC as provided in Section 903.23. <br /> <br />Section 903.23 - Rate Extensions <br /> <br />. <br /> <br />(a) The following regulations shall ~pply to the extension of rates <br />which were previously confirmed and approve~ by the FERC, the Federal Power <br />Commission or the Administrator of the Econqmic Regulatory Administration, <br />or established by the Secretary of the Inte~ior: <br />I <br />(1) The Administrator shall giv~ Notice of the proposed <br />extension at least 30 days before the expiration of the prior confirmation <br />and approval, except that such period may be shortened for good cause shown. <br /> <br />(2) The Administrator shall allow for consultation and comment, <br />as provided in Section 903.14, for such period as he or she may provide. <br />One or more public information and comment fforum(s) may be held, as provided <br />in Sections 903.15 and 903.16, at such time~S) and location(s) and with such <br />advance notice as the Administrator may provide. <br />, <br />! <br />(3) Following the conclusion of:the consultation and comment <br />period, the Assistant Secretary may extend the rates on an interim basis. <br />Such extension shall be governed by Sections 903.21(d) and 903.22. <br /> <br />(b) Provisional Rates may be extende~ by the Assistant Secretary <br />without advance notice or comment. The Assistant Secretary shall publish <br />notice in the Federal Register of such exte~ision and shall promptly advise <br />the FERC of the extens10n.
