<br />given at least 30 days in advance of the first forum at each location and <br />shall include the purpose, date, time, placel and other information relevant <br />to the forum, as well as the locations whereipertinent documents are avail- <br />able for examination and/or copying. <br /> <br />(b) The Administrator shall designate. a forum chairperson. At the <br />forum, PMA representatives may question those persons making oral statements <br />and comments. The chairperson shall have discretion to establish the <br />sequence of and time limits for oral presentations and to determine if the <br />comments are relevant and noncumulative. Forum proceedings shall be trans- <br />cribed. Copies of all documents introduced 'shall be available at a desig- <br />nated location for inspection, and copies s~all be furnished on request for <br />which the Administrator may assess a fee. copies of the transcript may be <br />obtained from the transcribing service. <br /> <br />Section 903.l7 - Revised Proposed Rates <br /> <br />During or after the consultation and qomment period and review of the <br />oral and written comments on the .Proposed Rates, the Administrator may <br />develop Revised Proposed Rates upon which, in the Administrator's judgment, <br />further public comment should be invited. In such a case, the Administrator <br />shall afford interested persons at least 30idays to submit further written <br />comments to the PMA regarding the Revised Proposed Rates and may convene one <br />or more additional public information and/or public comment forums. The <br />Administrator shall give Notice of any such, additional forums and opportuni- <br />ty to submit written comments. <br /> <br />Section 903.21 - Provisional Rates <br /> <br />(a) Following completion of the conspltation and comment period and <br />review of any oral and written comments on ~he Proposed Rates, or Revised <br />Proposed Rates, the Administrator shall develop rates which, in the Assis- <br />tant Secretary's judgment, should be confirmed, approved, and placed in <br />effect on an interim basis. A statement shall be prepared and made avail- <br />able to the public of the principal factors on which the Assistant <br />Secretary's decision was based. It shall include an explanation responding <br />to the major comments, criticisms, and alternatives offered during the <br />comment peri od. . <br />i <br /> <br />(b) The Assistant Secretary shall s~t the effective date for the <br />rates he or she has confirmed and approved ion an interim basis (Provisional <br />Rates). The effective date shall be at le4st 30 days after the Assistant <br />Secretary's decision, except that the effective date may be sooner when <br />appropriate to meet a contract deadline, to avoid financial difficulties, to <br />provide a rate for a new service, or to ma~e a minor rate adjustment. <br /> <br />(c) The effective date of the Provi$ional Rates for the purpose of <br />billing may be adjusted by the Administrat9r to coincide with the beginning <br />of the next billing period following the d~te set by the Assistant Secretary. <br />! <br />(d) The Provisional Rates shall rem~in in effect until(l) they are <br />confirmed and approved on a final basis by, the FERC under Section 903.22(b), <br /> <br /> <br />. <br /> <br />60 <br /> <br />" <br />
