WHEREAS. said new report provides more accurate and current ..
information than the information contained in that portion of ..
the floodplain report previouslY designated by Resolution No. 66
on January 19. 1977. relating to the reach of Coal Creek from a
point 3700 feet upstream of Perry Street upstream to the
Boulder-Weld County line; and

WHEREAS. the Board of County Commissioners of Weld County.
Co lorado. has reques ted the Colorado Wa ter Conserva t ion Board to
designate and approve the floodplains set forth in the aforesaid
new report; and

WHEREAS. Section 37-60-l06(1)(c). Colorado Revised Statutes.
requires the Colorado Water Conservation Board to assist in the
prevention of floods and flood damages therefrom; and

WHEREAS. Sections 31-23-301 and 30-28-111. Colorado Revised
Statutes. provide that legislative bodies of local jurisdictions
may provide zoning regu la t ionj; for land uses on or a long any
storm or floodwater runoff channel or basin only after
designation and approval by the Colorado Water Conservation
Board; and

WHEREAS, Section 37-60-l06{l) (c). Colorado Revised Statutes.
directs the Colorado Water Conservation Board to designate and
approve storm or floodwater cunoff channels or basins and to
make such designations available to legislative bodies of local ..
jurisdictions; and ..

WHEREAS. the information i[1 said new report relating to that
reach of Coal Creek from a point 3700 feet upstream of Perry
Street upstream to the Boulder-Weld County line meets all of the
requirements for detailed floodplain information listed under
the Board's "Rules and Regu '1a t ions for the Des igna t ion and
Approval of Floodplains and of Storm or Floodwater Runoff
Channels in Colorado" (2 CCR 408-1);

NOW. THEREFORE. BE IT ~ESOLVED by the Colorado Water
Conservation Board in regular meeting assembled in Northglenn.
Colorado. this 17th day of January. 1991. that it does hereby
designate and approve the loo-year floodplain as described by
the floodwater surface elevations and profiles in said new
repor t. da ted September 28. 1990. for those studY reaches of
Coal Creek that are within the unincorporated territory of Weld
County as of January 17. 1991. and that are located between a
point 3700 feet upstream of perry Street and the Boulder-Weld
County line. and does hereby rescind that portion of Resolution
No. 66. dated January 19. 1977. regarding the reach of Coal
Creek from a point 3700 feet upstream of Perry Street upstream
to the Boulder-Weld County line. as presented in the October
1976. report; and
