WHEREAS,
1973, requires
the prevention

Section 37-60-106(1), Colorado Revised Stat~tes
the Colorado Water Conservation Board to assist in
of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado RevLsed
Statutes 1973, provide that such legislative bodies of local
jurisdictions may provide zoning regulations for land uses o~ or
along any storm or floodwater runoff channel or basin only after
designation and approval by the Colorado Water Conservation
Board; and

WHEREAS, Section 37-60-l06(1)(c), Colorado Revised Statutes
1973, directs the Colorado Water Conservation Board to designate
and approve storm or floodwater runoff channels or basins and to
make such designations available to legis lati ve bodies of local
jurisdictions; and

WHEREAS, City of Manitou Springs officials have stated that
they will regulate the approximate storm and floodwater runoff
channels (Zone A) on a case-by-case basis subject to a detailed
hydrologic and hydraulic analysis by a professional engineer; and

WHEREAS, the staff' of the Board has reviewed said revised
information and data and does hereby recorrunend to the COlorado
Water Conservation Board that the Board designate and approve as
floodplain areas those areas inundated by a 100-year flood
(intermediate regional flood) as described by the floodwater
surface elevations and profiles in said new report, and further
recommends that the floodplain designation for those portions of
Fountain Creek within the present corporate boundaries of the
City of Manitou Springs (only) as approved by Resolution No. 42,
adopted February 26, 1975, be rescinded;

NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conser-
vation Board in regular meeting assembled in Denver, Colorado,
this 5th day of January, 1984, that it does hereby designate and
approve as floodplain areas those areas described as being
inundated by a 100-year flood as described by the floodwater
surface elevations and profiles in said new report, dated August
1, 1983, and does hereby rescind that said portion of Resolution
No. 42, dated February 26, 1975; and

BE IT FURTHER RESOLVED that the Board does hereby designate
and approve as storm or floodwater runoff channels or basins
those areas as delineated by Zone A in the flood insurance report
contingent upon the understanding that the City of Manitou
Springs will regulate the approximate storm and floodwater runoff
channels (Zone A) on a case-by-case basis subject to a detailed
hydrologic and hydraulic analysis by a professional engineer; and
