<br />" <br />~ <br /> <br />WHEREAS, <br />1973, requires <br />the prevention <br /> <br />Section 37-60-106(1), Colorado Revised Stat~tes <br />the Colorado Water Conservation Board to assist in <br />of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado RevLsed <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses o~ or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-l06(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legis lati ve bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, City of Manitou Springs officials have stated that <br />they will regulate the approximate storm and floodwater runoff <br />channels (Zone A) on a case-by-case basis subject to a detailed <br />hydrologic and hydraulic analysis by a professional engineer; and <br /> <br />WHEREAS, the staff' of the Board has reviewed said revised <br />information and data and does hereby recorrunend to the COlorado <br />Water Conservation Board that the Board designate and approve as <br />floodplain areas those areas inundated by a 100-year flood <br />(intermediate regional flood) as described by the floodwater <br />surface elevations and profiles in said new report, and further <br />recommends that the floodplain designation for those portions of <br />Fountain Creek within the present corporate boundaries of the <br />City of Manitou Springs (only) as approved by Resolution No. 42, <br />adopted February 26, 1975, be rescinded; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conser- <br />vation Board in regular meeting assembled in Denver, Colorado, <br />this 5th day of January, 1984, that it does hereby designate and <br />approve as floodplain areas those areas described as being <br />inundated by a 100-year flood as described by the floodwater <br />surface elevations and profiles in said new report, dated August <br />1, 1983, and does hereby rescind that said portion of Resolution <br />No. 42, dated February 26, 1975; and <br /> <br />BE IT FURTHER RESOLVED that the Board does hereby designate <br />and approve as storm or floodwater runoff channels or basins <br />those areas as delineated by Zone A in the flood insurance report <br />contingent upon the understanding that the City of Manitou <br />Springs will regulate the approximate storm and floodwater runoff <br />channels (Zone A) on a case-by-case basis subject to a detailed <br />hydrologic and hydraulic analysis by a professional engineer; and <br /> <br />-2- <br />
