<br />NOTICE OF FINAL ADOPTION
<br />
<br />PURSUANT to the provisions of section 24-4-103(4)(a), C,R,S,
<br />
<br />NOTICE IS HEREBY GIVEN that the Colorado Water Quality Control Commission, after a public
<br />rulemaking process and complying with the provisions of 24-4-103 C,R.S" amended on March 9,
<br />1999, on both a permanent and emergency basis, pursuant to 25-8-202(1)(c) and (2); and 25-8-
<br />205; 25-8-401; 25-8-501,1; and 25-8-504 C,R.S" and Section 21,3 of the "Procedural Rules" the
<br />regulation entitled:

<br />"Confined Animal Feeding Operations Control Regulation" Regulation #81 (5 CCR 1002-81)
<br />
<br />Providing for requirements to implement new section 25-8-501,1 of the Water Quality Control Act,
<br />approved by the voters as "Amendment 14" on the November 3, 1998, ballot, pertaining to housed
<br />commercial swine feeding operations. Amendment 14 requires that the Commission promulgate
<br />rules by March 31,1999.

<br />Also, pursuant to 24-4-103(8)(b), C,R.S., this amendment was submitted to the Attorney General
<br />for review and was found to be within the authority of the Water Quality Control Commission to
<br />promulgate, and further that there are no apparent constitutional deficiencies in its form or
<br />substance, Furthermore, in adopting this amendment the Commission also adopted a general
<br />Statement of Basis, Specific Statutory Authority, and Purpose in compliance with 24-4-103(4),
<br />C,R.S.

<br />The emergency amendment is effective March 30, 1999 through April 30, 1999, This amendment
<br />will be submitted to the Office of Legislative Legal Services within twenty (20) days after the date
<br />of the Attorney General's Opinion, pursuantto 24-4-1 03(8)(d), C,R.S., and to the Secretary of State
<br />in time for April, 1999 publication in the Colorado Register pursuant to 24-4-103(5) and (11)(d),
<br />C.R.S" and will become effective as a permanent rule on April 30, 1999.
