" dated <br />August. 1972. was prepared by Frasier & Gingery. Inc.. for the <br />Urban Drainage and Flood Control District. the City and County <br />of Denver. Jefferson County. and the City of Lakewood: and <br /> <br />WHEREAS. the Colorado Water Conservation Board. as <br />requested by the City of Lakewood. by Resolution No. 38. <br />adopted December 4. 1974. designated and approved those <br />portions of the floodplains described in said report for weir <br />Gulch. North Weir Gulch. and South Weir Gulch within the <br />corporate limits of the City of Lakewood only; and <br /> <br />WHEREAS. that portion of the report entitled "Major <br />Drainageway Planning. Sanderson Gulch/Weir Gulch." dated August <br />1972. pertaining to unincorporated Jefferson County has not <br />been designated nor approved by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS. Jefferson County has requested the Colorado Water <br />Conservation Board to designate and approve the floodplain <br />areas as set forth in the aforesaid report for North Weir Gulch <br />and South Weir GUlch wi thin unincorpora ted Jefferson County; <br />and <br /> <br />WHEREAS. Section 37-60-106(1). Colorado Revised Statutes. <br />requires the Colorado Water Conservation Board to assist in the <br />. prevention of floods and damages therefrom; and <br /> <br />WHEREAS. Sections 31-23-301 and 30-28-l11. Colorado Revised <br />Statutes. provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS. Section 37-60-106(1){c). Colorado Revised Statutes. <br />directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />l535E <br />
