<br />FLOODPLAIN CONSISTENCY <br /> <br />WHEREAS, the detailed floodplain information contained in said report is not consistent <br />with the detailed infonnation contained in Resolution Nos. 278 and 373; and <br /> <br />WHEREAS, the detailed floodplain infomtation contained in said report dated March 1978 <br />is considered to be superseded by the detailed floodplain infonnation contained in Resolution Nos. <br />278 and 373; and <br /> <br />c.R.S AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-:28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />COMPLIANCE WITH CWCR TECHNICAL STANDARDS <br /> <br />WHEREAS, the Federal msurance Administration did not publicly release said report dated <br />March 1978 due to lost or missing technical backup data; and <br /> <br />WHEREAS, the floodplain infonnation in said report dated March 1978 for Clear Creek <br />and South Clear Creek in the Town of Georgetown does not meet all of the requirements for <br />detailed infonnation listed under the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Stonn or Floodwater Runoff Channels in Colorado" (2 CCR 408- <br />1). <br /> <br />DESIGNATION AND APPROVAL ACTION <br /> <br />NOW, THEREFORE. BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Denver, Colorado, this 21st day of July 1997, that it does hereby <br />rescind the storm or floodwater runoff channels Of basins those portions of Clear Creek and South <br />Clear Creek within the Town of Georgetown described by detailed floodplain infonnation in said <br />report dated March 1978; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is directed to send a <br />certified copy of this resolution to the Town of Georgetown; the Board of County Commissioners <br />of Clear Creek County; the Colorado Office of Emergency Management; the U.S. Army Corps of <br />Engineers, Omaha District; and the Federal Emergency Management Agency. <br /> <br />2 <br />
