<br />WHEREAS. said new report provides more accurate and current '. <br />informa tion tha n the inf orma cion conta ined in that port ion of .. <br />the floodplain report previously designated by Resolution No. 66 <br />on January 19. 1977. re la t ing to the reach of Coa 1 Creek f rom a <br />point 3700 feet upstream of Perry Street upstream to the <br />Boulder-Weld County line; and <br /> <br />WHEREAS. the Town of Erie. Colorado. has requested the <br />Colorado Water Conservation Board to designate and approve the <br />floodplains set forth in the aforesaid new report; and <br /> <br />WHEREAS. Section 37-60-106(1)(c). Colorado Revised Statutes. <br />requires the Colorado Water conservation Board to assist in the <br />prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS. Sections 31-23-301 and 30-28-111. Colorado Revised <br />Sta tutes. provide that legis la ti ve bod ies of loca 1 jur iSdictions <br />may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS. Section 37-60-l06(l)(c). Colorado Revised Statutes. <br />directs the Colorado Water conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to <br />make such designations availaPle to legislative bodies of local . <br />jurisdictions; and .. <br /> <br />WHEREAS. the information in said new report relating to that <br />reach of Coal Creek from a point 3700 feet upstream of Perry <br />Street upstream to the Boulder-Weld County line meets all of the <br />requirements for detailed floodplain information listed under <br />the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); <br /> <br />NOW. THEREFORE. BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular meeting assembled in Northglenn. <br />Colorado. this 17th day of January. 1991. that it does hereby <br />designate and approve the 100-year floodplain as described by <br />the floodwater surface elev~tions and profiles in said new <br />report. dated September 28. 1990. for those study reaches of <br />Coal Creek that are within the corporate limits of the Town of <br />Erie as of January 17. 1991, and that are located between a <br />point 3700 feet upstream of Perry Street and the Boulder-Weld <br />County line. and does hereby rescind that portion of Resolution <br />No. 66. dated January 19. 1977. regarding the reach of Coal <br />Creek from a point 3700 feet upstream of Perry Street upstream <br />to the Boulder-Weld County line. as presented in the October <br />1976. report; and <br /> <br />e <br /> <br />-2- <br />
