<br />Mr. John Matticks <br />Mr. Ross McKay <br />September 14, 1993 <br />Page 3 <br /> <br />therefore, legitimately claim ignorance of the regulatory requirements, I realize that our friends <br />in the Midwest (including two states in Region VIII) have taken a lot of FEMA's attention this <br />summer. Nevertheless, I feel that communities like Florence have to be notified in no uncertain <br />terms that their floodplain regulations obligate them to require floodplain development permits <br />before activities such a, those I've described take place in their floodplains. As unpleasant as <br />it is, enforcement is essential to a viable NFIP, <br /> <br />Recommendations <br /> <br />I would like to recommend the following steps to begin the process of correcting the situation <br />in Florence: <br /> <br />I) FEMA should notify Florence in writing that a floodplain development <br />permit application should be prepared and reviewed immediately so the <br />project can be brought into compliance with the City's regulations. <br /> <br />2) Florence, FEMA and the CWCB should assure that the final grading plan <br />for the proposed subdivision adequately addresses flooding from Oak Creek <br />and that all floodwater has a safe place to go before any further work is <br />conducted on the project. <br /> <br />3) Florence, the CWCB and Region VIII should be notified by FEMA <br />Headquarters of the current status of the review of the draft LMMP study <br />by Love & Associates, <br /> <br />4) The cost of any further work on the LMMP study, including review work, <br />that is directly attributable to the filling in the floodplain should be borne <br />by the City of Florence and/or the developer. <br /> <br />5) A workshop, to be conducted by FEMA, providing training in floodplain <br />m;magement and floodplain regulations should be mandated for the elected <br />officials of Florence, their Planning Commission and their staff as a <br />condition of not being placed on probation. <br /> <br />6) A Community Assessment Visit should be conducted jointly by FEMA and <br />the CWCB within three months to assure that all corrective measures have <br />been implemented. <br />
