OAK CREEK FLOODWAY, FLORENCE, COLORADO

Dear Ken:

I have been advised by Dr. John Liou, P,E" P,L.S, of FEMA, Region VIII, that FEMA will not
accept the Oak Creek floodway delineation prepared by Love & Associates, Inc, unless the City of
Florence (City) issues a letter stating that the land in the floodplain upstream of the railroad tracks
in the left overbank (looking downstream) for approximately 1/4 mile will never be developed or
blocked.

The City must further commit to remove sediment from the bridge openings to maintain their flood
water carrying capacity. Also, if the grades of the railroad tracks are ever raised, the City will need
to notify FEMA so that regulatory officials can evaluate the need to re-study the floodplain based
upon changes in the key hydraulic control structure of the floodplain.

If you have any questions, feel free to contact Dr. John Liou at FEMA, Region VIII, (303) 235-
4836.

Sincerely,

~ ASSOCIATES, INC,

David J, Love, P.

DJL:jg

cc: Dr. John Liou, P,E., P,L.S, - FEMA, Region VIII
~ Lang - Colorado Water Conservation Board
