<br />1" <br /> <br />4.A.(5)(d) A Class IV dam is a dam for which no loss of human <br />life is expected, and which damage will occur only to the dam owner's <br />property in the event of failure of the dam. <br /> <br />4.A.(6) A "Dam" is a man-made barrier, together with appurtenant <br />structures, constructed above the natural surface of the ground for <br />the purpose of impounding water. (For Exemptions, See Rule 18.) <br /> <br />4.A. (6)(a) A "Jurisdictional Dam" is a dam which impounds <br />water above the elevation of the natural surface of the ground <br />creating a reservoir with a capacity of more than 100 acre-feet, or <br />creates a reservoir with a surface area in excess of 20 acres at the <br />high-water line, or exceeds 10 feet in height measured vertically from <br />the elevation of the lowest point of the natural surface of the ground <br />where that point occurs along the longitudinal centerline of the dam <br />up to the flowline crest of the emergency spillway of the dam. For <br />reservoirs created by excavation, the vertical height shall be <br />measured from the invert of the outlet. The State Engineer shall have <br />final authority over determination of the vertical height. <br /> <br />4.A.(6)(b) A nNonjurisdictional Dam" is less than the size and <br />capacity of a jurisdictional dam. <br /> <br />4.A. (6) (c) A "Minor Dam" does not exceed 20 feet in vertical <br />height and 100 acre feet in capacity (see Figure 1). <br /> <br />4.A. (6)(d) A "Small Dam" is greater than 20 feet in vertical <br />height but equal to or less than both 40 feet and 1000 acre-feet in <br />capacity, or is greater than 100 acre feet but equal to or less than <br />both 1,000 acre-feet in capacity and 40 feet in vertical height (see <br />Figure 1). <br /> <br />4.A. (6)(e) An "Intermediate Dam" is greater than 40 feet in <br />vertical height but equal to or less than both 100 feet and 50,000 <br />acre-feet in capacity, or is greater than 1,000 acre feet in capacity <br />but equal to or less than both 50,000 acre feet in capacity and 100 <br />feet in vertical height (see Figure 1), <br /> <br />4.A. (6)(f) A "Large Dam" is greater than 100 feet in vertical <br />height, or greater than 50,000 acre feet in capacity (see Figure 1). <br /> <br />4.A. (6)(g) A "Diversion Dam" is a dam constructed for the <br />purpose of diverting water from the natural stream bed into a canal, <br />tunnel, ditch, or pipeline, and which is not designed or operated for <br />the purpose of impounding significant amounts of water. A dam that <br />both impounds water and diverts water into a canal, tunnel, ditch, or <br />pipeline shall be considered a dam and is subject to these rules. <br /> <br />- 3 - <br />
