My opinion will be of general, rather than specific <br />application. <br /> <br />The questions of right-of-way, acquisition, power of eminent domain <br />and responsibility for channel maintenance, not appearing to be any <br />part of this project we are discussing, have not been considered. <br /> <br />A. THE USE OF A PRESCRIBED RIGHT-OF-WAY <br />FOR IMPROVEMENTS BY VIRTUE OF THE CHANNEL <br />HAVING PRE-DATED URBAN DEVELOPMENT. <br /> <br />Prescriptive rights to the use of land can be acquired in <br />Colorado. Our statute CRS 118-7-1, 1963, as amended, provides that <br />eighteen years of adverse possession of any land shall be deemed <br />conclusive evidence of ownership. The crucial period is, obviously, <br />
