<br />. <br /> <br />. <br /> <br />. <br /> <br />LOCAL REQUEST FOR DESIGNATION <br /> <br />WHEREAS, staff members from the CWCB and Montgomery Watson met with the Montrose <br />County officials regarding floodplain management activities and the CWCB's designation and <br />approval process for floodplain information, and the County concurred with the proposed designation <br />action and transmitted a letter to the CWCB staff requesting designation by the Board; and <br /> <br />c.R.S. AUTHORITY <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado Water <br />Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, the detailed floodplain information, as listed in Table I, in said new Floodplain <br />Information Report and Hydrology Addendum with included maps, meets all of the requirements listed <br />under the Board's "Rules and Regulations for the Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the approximate riverine floodplain information, as listed in Table 2, in said new <br />Floodplain Information Report and Hydrology Addendum with included maps meets all of the <br />requirements listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, 100-year peak discharges within Montrose County for the streams listed in Table <br />2 (except for the San Miguel River where the drainage area is larger than 1,200 square miles) were <br />developed by the consulting firm of Montgomery Watson utilizing the latest available CWCB regional <br />regression equations entitled "Guidelines for Determining 100-year Flood Flows for Approximate <br />Floodplains in Colorado"; and <br /> <br />WHEREAS, hydrographs and peak flood flows on the lower Uncompahgre River are <br />physically altered due to effects caused by the Ridgway Reservoir, but those effects were not taken into <br />consideration in the hydrologic calculations due to standard policy regarding flood control operation <br />requirements for dams in Colorado; and <br /> <br />3 <br />
