<br />WHEREAS, the said new report includes approximate information for the John Law <br />Ditch which is consistent with the approximate information included in Resolution No. 156; tit <br />and <br /> <br />WHEREAS, the Town Board of Windsor, Colorado, has requested the Colorado <br />Water Conservation Board to designate and approve the floodplains set forth in the <br />aforesaid new report; and - .. <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the <br />Colorado Water Conservation Board to assist in the prevention of floods and flood damages <br />therefrom; and <br /> <br />WHEREAS, Section 37-60-106( 1)( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels <br />or basins and to make such designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, Section 31-23-301 and 30-28-111, Colorado Revised Statutes, provide <br />that legislative bodies of local jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, the said new report meets all of the requirements as detailed floodplain .. <br />information under the Board's "Rules and Regulations for the Designation and Approval. <br />of Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-h). <br /> <br />NOW, TIlEREFORE, BE IT RESOLVED by the Colorado Water Conservation <br />Board in regular meeting assembled in Denver, Colorado this 8th day of May, 1992, that it <br />does hereby designate and approve the 100"year floodplain as described by the floodwater <br />surface elevations and profiles in said new report, revised September 27, 1991, for the stated <br />study reach of the Cache la Poudre River from a point 123,744 feet upstream of its <br />confluence with the South Platte River upsU'eam to a point 137,900 feet upstream of that <br />confluence including Cache la Poudre River Divided Flow at County Road 17 and State <br />Highway 257 Divided Flow both of which ll1'e parts of the Cache la Poudre River in the <br />defined reach and does hereby rescind that same portion of Resolution No. 156, dated <br />March 17, 1980 regarding the study reach of the Cache la Poudre River; and <br /> <br />BE IT FURTIlER RESOLVED that the Secretary of the Board is directed to send <br />a certified copy of this resolution to the Board of County Commissioners of Larimer County; <br />the Board of County Commissioners of Weld County; the Town of Windsor, Colorado; the <br />Colorado Division of Disaster Emergency Services; and the Federal Emergency <br />Management Agency. <br /> <br />2 <br /> <br />tit <br />
