No. 171 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State centennial Build:ing <br />1313 Sherman Street <br />Denver, colorado 80203 <br /> <br />December 2, 1980 <br /> <br />R E ~ 0 1 Q T.1 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, Town of <br />Minturn, Eagle County, Colorado, U which includes floodplain infor- <br />mation and data fOr the Eagle River, dated March 1980. has been <br />prepared by Gingery Associates, Inc;, under contract with the <br />Federal Insurance Administration; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, ,the, Town of Minturn has requested the Colorado water <br />Conservation Board to designate and approve the" flOOdplain areas <br />as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37-60-106(1), ColOrado Revised Statutes <br />1973, requires the Colorado "WateJ: Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31~23-201 and 30-28'-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />j ur isdictions may provide zoning regu lations .' for land uses on or <br />along any storm or floo.dwater runoff channel or basin only after <br />designation and approval by the ColOrado water Conservation Board; <br />and <br /> <br />WHEREAS, Section 37-60-106 (1) (c) , colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater ):'unoff channels or basins and to <br />make such designations available to. legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the ColOradO water Conservation Board <br />that the Board designate and app):'ove as flOOdplain areas thOse <br />areas inundated by a 100-year flood (intermediate regional floOd) <br />as described by the floodwater surface elevations and prOfiles in <br />said report; . <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conser- <br />vation Board in regular meeting assembled in Denver, ColoradO, <br />this 2nd day of December, 1980, that it does hereby designate and <br />approve as flOOdplain areas those areas described as being inundated <br />by a 100-year flood as described by the floodwater surface eleva- <br />tions and profiles in said report; and <br />
