No. 161 <br /> <br />\ <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />March 17, 1980 <br /> <br />R ~ ~ 0 L U T ~ 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, Town <br />of Eagle, Colorado," which includes floodplain information and <br />and data for Brush creek, dated SepternlJer, 1979. has been prepared <br />by Gingery Associates, Inc., under contract with the Federal <br />Insurance Administration; and <br /> <br />WHEREAS, said report describes and outlines the floOdplain <br />data and information for the storm and floOdwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the Town of Eagle has requested the Colorado <br />Water Conservation BOard to designate and approve the floodplain <br />areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised statutes <br />1973, requires the ColoradO Water Conservation Board to assist in <br />\ the prevention of floods and flood damages therefrom; and <br />I <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised Statutes 1973, provide that such legislative bodies of <br />local jurisdictions may provide zoning regulations for land uses <br />on or along any storm or floodwater runoff channel Or basin only <br />after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (cl, Colorado Revised <br />Statutes 1973, directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of <br />lOcal jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report <br />and does hereby recommend to the Colorado Water Conservation Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional floOd) <br />as described by the floOdwater surface elevations and profiles in <br />said report; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the ColoradO water <br />Conservation Board in regular meeting assembled in Denver, Colorado, <br />this 17th day of March, 1980, that it does hereby designate and <br />approve as floodplain areas those areas described as being inundated <br />by a 100-year flood as described by the floodwater surface eleva- <br />tions and profiles in said report; and <br />
