/

.

.

!

January 23, 1980

y~. John R. McGinn
hdministrator
city of Canon city
P. O. BOx 711
Canon city, CO 81212

Dear Mr. McGinn:

By this communication, I would like to update the study
process regarding our flood hazard study on the Arkansas River
and North Canon Drainage. Tnis letter will update developments
since our December 22, 1980, meeting, hold in Canon city. At
your request, I did talk to the EPA regarding the holdup of
sewer grant funds. Mr. Jim Brooks agreed that ho would give us
additional time for completion of the flood hazard study. Since
I last talked to you, there has been a number of happenings
regarding our flood hazard studies. In particular, with the
mapping contractor (Ponderosa Engineering) it appears that much
communication has taken place between y~. Rupp and Kucera and
Associates, Inc. On January 22, 1981, Mr. Kerry Dynes, fro~
Kucera's Denver Office, called to advise me of their concerns
regarding the mapping phase of the flood hazard studies. They
feel that Mr. Chuck Rupp's proposal of escrowing tho monies due
Kucera to the County co~~ssioners would be too complicated and
not worth the time. They proposed the following arrangement for
'r~doing the maps.

They proposed to redraw the maps using Mr. Rupp's new ground
control. h~en the ma~s have been completed, which is expected'to
be by January 3D, 1981. They will deliver the maps to th~ Board's
office for our review and checking. If the maps are found to be
acceptable, Kucera requires that the maps be returned to them, in
which case they will hold the maps until full payment is received
from ponderosa Engineering. Should the maps be completed as
promised by January 3D, it will be necessary for our office and
Bob ROhler, the city Engineer, to check the maps quickly. It
appears that we will finally obtain revised mapping. If the maps
are still wrong because of Rupp's field control. Kucera will require
some payment. Their attorney, Jack Kurant, confirmed this arrange-
ment by telephone on January 23, 1981.

.
