<br /> <br />,}: <br /> <br />-i", <br />. <br /> <br />RIGHr-0F-ENTRY FOR OJNSTROCITON <br /> <br />South Platte River Channel Improvement Project <br />(Project, Installation or Activity) <br /> <br />Union Avenue Project <br />(Tract Number or Other Property <br />Identification) <br /> <br />The undersigned, hereinafter called the "Contractor" in consideration of the <br />total CClIIIpensation to be paid by the State, for all land or easement rights herein- <br />after described, to be granted by subsequent agreement between the Contractor and <br />the State, or by judicial proceedings, hereby grants to the State, a pennit or <br />right-of-entry upon the following terms and conditions: <br /> <br />1. The Contractor hereby grants to the State, its agents, contractors. <br />and employees, hereinafter described at any time within a period of () <br />IIPllths from the date of this instrument, in order to perfonn construction work <br />relating to the above-described proj ect. <br /> <br />2. This pennit includes the right of ingress and egress on other lands of the <br />Contractor not described below, provided that such ingress and egress is necessary <br />and not otheJ:wise conveniently available to the State. <br /> <br />3. All tools, Equipment, buildings, improvements, and other property taken <br />upon or placed upon the land by the State shall remain the property of the State and <br />lIBY be raroved by the State at any time within a reasonable period after the expiration <br />of this pennit or right-of-entry. <br /> <br />4. The State shall have the right to patrol and police the lands hereinafter <br />described during the period of this pennit or right-of-entry. <br /> <br />5. It is tmderstood and agreed that if the State does not acquire title or <br />other necessary interest in said land prior to the expiration of this pennit or <br />right-of-entry, or any renewal thereof, the State agrees to be responsible for any <br />damage arising from the activity -f the State, its employees and/or contractors on <br />said lands, in the exercise of rights under this pennit or right-of-entry, and shall <br />repair such damages, or, in lieu thereof and at the option of the State, shall make <br />an appropriate settlarent with the Contractor. <br /> <br />The land affected by this pennit or righ-of-entry is located in the Cotmty of <br />, State of , and is described as follows: <br /> <br />SEE Attaclnnent 1 <br /> <br />WTINESS MY HAND AND SEAL this <br /> <br />day of <br /> <br />, 19 <br /> <br />(SEAL) <br />(SEAL) <br />
