'-'& <br /> <br />LICENSE AGREEMENT <br /> <br />THIS LICENSE AGREEMENT, made this 23rd day ot May <br />19 84 , between the CITY OF ENGLEWOOD, a municipal corporation of <br />the State of Colorado, herein referred to as "City", and DEPZ\R'l'MEN'J' <br />OF NA'rURAL RESOURCES, COLORADO WATER CONSERVATION BOARD, S'l'A'J'P; OF <br />COLORADO, herein referred to as "Licensee". <br /> <br />WI'J'NESSE'J'H <br /> <br />The term "Licensee" shall include employees, agents and <br />contractors of Licensee. <br /> <br /> <br />The terln l'property" as used herein refers to real property <br />and includes easements, rights of way, and other City interests in <br />land and may sometimes be referred to herein as "City property". <br /> <br />The City, by these presents, subject to the covenants <br />hereinafter set forth, does hereby authorize the Licensee, its <br />successors and assigns, to: <br /> <br />perform all activities under contract dated May 1, 1983 <br />between the Department of Natural Resources (Colorado <br />Conservation Board) and the City of Englewood and, <br />specifically, the right to enter upon the lands of the <br />City of Englewood as described in ruxhibit "A" attached <br />hereto and made a part hereof. <br /> <br />In granting this License, the City reserves the right to make <br />full use of the property involved as may be necessary or convenient <br />in the operations of the City and the City retains all right to <br />operate, maintain, install, repair, remove or relocate any of its <br />facilities located within the City's property at any time and in <br />such a manner as is consistent with the agreement between the <br />parties. <br /> <br />IN WITNESS WHEREOF, this instrument has been executed as of <br />the day and year first above written. <br /> <br />CITY OF ENGLEWOOD <br /> <br />APPROV~ <br /> <br /> <br />Directo 0 Utl lties <br /> <br />By a.i!m~_ <br /> <br />Clt~anager <br />
