<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />stoTIn or floodwater runoff channel or basin only after designation and approval by the Colorado <br />Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNIC~ STANDARDS <br />WHEREAS, the 100-year peak flow vll1ues for the streams listed in Table I have been <br />estimated by the Colorado Water Conservation Board using detailed hydrologic techniques as <br />approved under the Board's "Ru1es and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the hydrau1ic determinations for the streams listed in Table I were prepared by <br />FEMA using approximate hydrau1ic techniques approved under the Board's "Ru1es and Regu1ations <br />for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR408-1); and <br /> <br />WHEREAS, the regulation of floodplair1s by the Town of Walden shou1d take place on a <br />case-by-case basis following the procedures developed by Colorado Water Conservation Board staff <br />as outlined in Table 2: <br /> <br />Table 2 <br />CWCB procedure for regulating approximate Zone A floodplains <br /> <br /> , <br />Type of development proposal Hydraulic requirements for <br />in community developer " <br />Limited development Approximate <br />Limited development Approximate <br />Significant development Detailed <br />Significant development Detailed <br /> <br />2 <br />
