<br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide tl1at <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by tl1e Colorado Water <br />Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(I)(c), Colorado Revised Statutes, directs tl1e Colorado Water <br />Conservation Board to designate and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br /> <br />WHEREAS, tl1e detailed floodplain information, as listed in Table 2, in said new Floodplain <br />Information Report and Hydrology Addendum witl1 included maps, meets all of tl1e requirements listed <br />under tl1e Board's "Rules and Regulations for tl1e Designation and Approval of Floodplains and of <br />Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1) for detailed floodplain information; <br />and <br /> <br />WHEREAS, tl1e approximate floodplain information, as listed in Table 3, in said new <br />Floodplain Information Report and Hydrology Addendum witl1 included maps, meets all of tl1e <br />requirements listed under tl1e Board's "Rules and Regulations for tl1e Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1) for approximate <br />floodplain information; and <br /> <br />WHEREAS, a procedure for determining hydrology information in Gunnison County for <br />approximate floodplains of reservoirs, lakes, ponds, local storm drainage areas, and overflows from <br />irrigation ditches and canals has not been established by tl1e CWCB; and tl10se floodplain areas may <br />not be designated as approximate floodplain information witl10ut a procedure for estimating 100- <br />year peak flows, and tl1erefore tl1e local government should require tl1at a detailed hydrologic and <br />hydraulic study be performed by a professional engineer and submitted by tl1e developer or tl1e <br />development proponent prior to any floodplain development in tl10se cases; and <br /> <br />WHEREAS, Gunnison County should continue to regulate new development and construction <br />in floodplain areas on a case-by-case basis based on tl1e information presented in said new Flood <br />Insurance Study and Hydrology Addendum, or based on tl1e best available floodplain information tl1at is <br />accessible to tl1e County; and <br /> <br />3 <br />
