Where the quantity of Work with respect to any item that is covered <br />by a unit price differs materially and significantly from the quantity <br />of such Work indicated in the Contract Documents, an appropriate <br />Change Order shall be issued on recommendation of Architect to adjust <br />the unit price. <br /> <br />PART 12 - CHANGE OF THE CONTRACT TIME <br /> <br />12.01 <br /> <br />CONTRACT TIME CHANGED ONLY BY CHANGE ORDER <br /> <br />A. <br /> <br />The Contract Time may only be changed by a Change Order. Any claim <br />for an extension in the Contract Time shall be based on immediate <br />verbal notification to Architect followed by written notice delivered <br />to Owner and Architect within five days of the occurrence of the evenl; <br />giving rise to the Claim. Notice of the extent of the claim supporting <br />data shall be delivered within 15 days of such occurrence unless Arch:l- <br />tect allows an additional period of time to ascertain more accurate <br />data. All claims for adjustment in the Contract Time shall be deter- <br />mined by Architect if Owner and Contractor cannot otherwise agree. Any <br />change in the Contract Time resulting from any such claim shall be <br />incorporated in a Change Order. <br /> <br />B. <br /> <br />The Contract Time will be extended in an amount equal to time lost due <br />to delays beyond the control of Contractor if a claim is made therefol'e <br />as provided in paragraph 12.01.A. Such delays shall include, but not <br />be limited to, acts or neglect by Owner or others performing additionul <br />Work as contemplated by Part 7, or to fires, floods, labor disputes, <br />epidemics, abnormal weather conditions, or acts of God. <br /> <br />C. <br /> <br />All the time limits stated in the Contract Documents are of the essene,e <br />of the Agreement. The provisions of this Part 12 shall not exclude <br />recovery for damages (including compensation for additional professional <br />services) for delay by either party. <br /> <br />PART 13 - WARRANTY AND GUARANTEE; TESTS AND INSPECTIONS; CORRECTION, REMOVAL OR <br />ACCEPTANCE OF DEFECTIVE WORK <br /> <br />13.01 <br /> <br />WARRANTY AND GUARANTEE <br /> <br />A. <br /> <br />Contractor warrants and guarantees to Owner and Architect that, without <br />exception, all Work will be in accordance with the Contract Documents <br />and will not be defective. Four copies of all manufacturer's guaranties <br />or certificates that are required by the Contract Documents shall be <br />submitted to Owner through Architect prior to acceptance of the Work. <br />No exceptions to Contract Documents and guarantee or warranty require-. <br />ments are permitted. Prompt notice of all defects shall be given to <br />Contractor. All defective Work, whether or not in place, may be re- <br />jected, corrected or accepted as provided in this Part 13. <br /> <br />13.02 <br /> <br />ACCESS TO WORK <br /> <br />A. <br /> <br />Architect and Architect's representatives, other representatives of <br />Owner, testing agencies and governmental agencies with jurisdictional <br />-23- <br />
