If Owner has any objection to the coverage afforded by or other pro- <br />visions of the insurance required to be purchased and maintained by <br />Contractor the basis of its not complying with the Contract Documents, <br />Owner will notify Contractor in writing thereof within ten days of the <br />date of delivery of such certificates to Owner in accordance with <br />paragraph 2.05.B. If Contractor has any objection to the coverage <br />afforded by or other provisions of the policies of insurance required <br />to be purchased and maintained by Owner in accordance with paragraphs <br />5.04.A, 5.05.A, and 5.06.A on the basis of their not complying with <br />the Contract Documents, Contractor will notify Owner in writing thereof <br />within ten days of the date of delivery of such certificates to Con- <br />tractor. Owner and Contractor will each provide to the other such <br />additional information in respect of insurance provided by him as <br />the other may reasonably request. Failure by Owner or Contractor to <br />give any such notice of objection within the time provided shall con- <br />stitute acceptance of such insurance purchased by the other as comply- <br />ing with the Contract Documents. <br /> <br />I <br />I <br />I <br />I <br /> <br />5.07 ACCEPTANCE OF INSURANCE <br /> <br />A. Contractor shall supervise and direct the Work competently and ef- <br />ficiently, devoting such attention thereto and applying such skills <br />and expertise as may be necessary to perform the Work in accordance <br />with the Contract Documents. Contractor shall be solely responsible <br />for the means, methods, techniques, sequences and procedures of con- <br />struction, but Contractor shall not be solely responsible for the <br />negligence of others in the design or selection of a specific means, <br />method, technique, sequence or procedure of construction which is <br />indicated in and required by the Contract Documents. Contractor <br />shall be responsible to see that the finished Work complies accurately <br />with the Contract Documents. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />PART 6 CONTRACTOR'S RESPONSIBILITIES <br /> <br />6.01 SUPERVISION AND SUPERINTENDENCE <br /> <br />B. Contractor shall keep on the Work at all times during its progress a <br />competent resident superintendent, who shall not be replaced without <br />written notice to Owner and Architect except under extraordinary <br />circumstances. The superintendent will be Contractor's representa- <br />tive at the site and shall have authority to act on behalf of Con- <br />tractor. All communications given the superintendent shall be as <br />binding as if given to Contractor. <br /> <br />6.02 LABOR, MATERIALS, AND E~UIPMENT <br /> <br />A. Contractor shall provide competent, suitable qualified personnel to <br />survey and layout the Work and perform construction as required by <br />the Contract Documents. Contractor shall at all times maintain good <br />discipline and order at the site. Except in connection with the <br />safety or protection of persons or the Work or property at the site <br />or adjacent thereto, and except as otherwise indicated in the Supple- <br />mentary Conditions, all Work at the site shall be performed during <br />regular working hours, and Contractor will not permit overtime work <br />or the performance of Work on Saturday, Sunday or any legal holiday <br />without Owner's written consent given after prior written notice to <br />Architect. <br /> <br />-8- <br /> <br />I <br />I <br />
