<br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br /> <br />I <br /> <br />AGREEMENT <br /> <br />This Agreement is made this <br />1991, between the <br />quasi-municipal corporation <br /> <br />day of <br /> <br />, a <br />located in the County of <br />hereinafter referred to <br /> <br />and political subdivision <br />, State of Colorado, <br /> <br />as "Owner", and <br />a sole proprietorship, of <br />hereinafter referred to as "Contractor". <br /> <br />In consideration of the mutual covenants, agreements, conditions, and undertakings <br />hereinafter specified, Owner and Contractor agree as follows: <br /> <br />Section 1. Scope of Work. Contractor shall perform all work in accordance <br />with the plans and specifications as set forth in the Contract Documents, as <br />specified in Section 2 hereof, for <br /> <br />, <br />including furnishing all supervision, labor, equipment and materials therefore, <br />hereinafter referred to as "Project". <br /> <br />Section 2. Contract Documents. The Contract Documents, which comprise the <br />entire agreement and contract between Owner and Contractor, consist of this <br />Agreement and any Addendum thereto; Instructions to Bidders; Bid Form; Perform- <br />ance, Payment and Warranty Bond; Notice to Proceed; Drawings; Specifications; <br />Addendum No(s). to Specifications, if applicable; General Conditions; <br />Supplementary Conditions; and any modifications, change orders or other such <br />revisions properly authorized after the execution of this Agreement. The <br />Drawings, Specifications and General and Supplementary Conditions have been <br />revi ewed by , <br />(hereinafter "Architect"), who is to act as Owner's representative, assume all <br />duties and responsibilities and have the rights and authority assigned to <br />Architect in the Contract Documents in connection with completion of the work <br />in accordance with the Contract Documents. <br /> <br />Section 3. Agreement Price. Owner shall pay Contractor for the performance <br />of work and completion of the Project the total price of <br /> <br />Dollars ($ ) in accordance with the Bid Form submitted by <br />Contractor. The Agreement Price shall be subject to adjustment for changes in <br />the Drawings and Specifications or for extensions of time to complete perform- <br />ance, if approved by Owner and Contractor as hereinafter provided, and for <br />changes in quantities, if bid on a unit-price basis in the Bid Form, which <br />shall be verified by the Architect. <br /> <br />Section ~. Progress Payments. Owner will make progress payments monthly on <br />account of the Agreement Price in accordance with applications for partial <br />payment prepared by the Contractor for work performed to date and approved <br />by the Architect and Owner. Contractor shall submit all applications for <br />partial payment and Owner shall make partial payments in accordance with the <br />Contract Documents. Progress payments shall not constitute final acceptance <br />of work. <br /> <br />A-1 <br />
