<br />LABOR AND MATERIALS PAYMENT BOND
<br />
<br />KNOW ALL MEN BY THESE PRESENTS THAT
<br />
<br />as Principal, hereinafter called the Contractor, and
<br />
<br />as Surety, hereinafter called the Surety, are held firmly bound unto
<br />
<br />as Obligee, hereinafter called the Owner, for the use and benefit of claimants
<br />
<br />as hereinbelow defined, in the amount of
<br />

<br />). for the payment whereof the Contractor and
<br />
<br />the Surety bind themselves, their heirs, executors, administrators, successors
<br />
<br />and assigns, jointly and ,severally, firmly by these presents.

<br />WHEREAS, the Contractor has by written agreement dated
<br />
<br />19 entered into a Contract with Owner for
<br />
<br />in accordance with drawings and specifications prepared by
<br />
<br />which Contract is by reference made a part hereof, and is hereinafter referred
<br />
<br />to as the Contract.
<br />
<br />NOW, THEREFORE, the condition of this obligation is such that if the Contractor
<br />shall promptly make payment to all claimants as hereinafter defined, for all
<br />labor and material used or reasonably required for use in the performance of
<br />the Contract, then this obligation shall be void; otherwise, it shall remain
<br />in full force and effect, subject, however, to the following conditions:
<br />
<br />a. A claimant is defined as one having a direct contract with the Principal
<br />or with Subcontractor of the Principal who supplies machinery, tools, or equip-
<br />ment in the prosecution of the work, and mechanics, materialman, contractors,
<br />subcontractors, builders, all persons of every class performing labor upon or
<br />furnishing directly to the owner or persons furnishing labor or materials to be
<br />used in construction, alteration, improvement, addition to or repair, either in
<br />whole or in part, of any building, mill, bridge, ditch, flume, aqueduct,
<br />reservoir, tunnel, fence, railroad wagon road, tranway, or any other structure
