WHEREAS, a floodplain info~mation'report entitled "Floodplain
Information Report, North Clear Creek, Gregory Gulch, Chase Gulch,
Black Hawk, Color?-do," dated Jupe 1980, has been prepared by Owen
Ayres and 'Associates, Inc., at the request of ,the city of Black
Hawk and the Colorado Water Conservation Board; and

WHEREAS, said report descr~bes and outlines the floodplain
data and information fOr the storm and floodwater runoff channels
or basins of the study area; an8

WHEREAS, the city'of Black Hawk has requested the Colorado
Water COnservation.Board to desLgnate and approve the floodplain
areas as' set, forth in, theafoieilaid report; and

WHEREAS, Section 37-60-106 (I) , Colorado Revised Statutes
1973, requires the COlorado Wat@r COnservation Board to assist in
the prevention of floods and flc)od damages' therefrom; and

WHEREAS, Sections 31-23-20i and 30-28-lll, Colorado Revised
Statutes 1973, provide that suc~ legislative bodies of local juris-
dictions may provide zoning reg~lations for land uses on Or along
any storm Or floodwater runoff channel or basin only afterdesig-
nation and approval by the colotado Water Conservation Board; and

WHEREAS, Section 37~60-l06(1) (c), Colorado Revised Statutes
1973, directs the Colorado Watet Conservation Board to designate
and approve storm or floodwater runoff channels or basins and to
make such designations available to legislative bodies of lOcal
jurisdictions; and

WHEREAS, the staff of the ~Oard has reviewed said report and
does hereby recommend to the colorado Water Conservation Board

areas inundated by a lOa-year flood (intermediate regional flood)
as described by the floodwater surface elevations and profiles in
said report;

NOW, THEREFORE, BE IT RESOLVED by the Colorado Water conser-
vation Board in regular meeting assembled in Denver,Colorado,
this 5th day of May, 1981, that it does hereby designate and
approve as floodplain areas those areas described as being inun-
dated by a 100-year flood as described by the floodwater surface
elevations and profiles in said report; and
