<br />WHEREAS, sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the ColQrado Water Conservation <br />Board; and <br /> <br />WHEREAS, section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Wat~r Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such' designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said revised <br />information and data and does hereby recommend to the Colorado <br />Water Conservation Board that the Board designate and approve as <br />floodplain areas those areas inundated by a 100-year flood <br />(intermediate regional flood) as described by the floodwater <br />surface elevations and profile,> in said new report, and further <br />recommends that all previous floodplain designations for that <br />portion of Lower Boulder Creek between Vall.ey View Road and the <br />Boulder-Weld County Line as approved by Resolution No, 8, adopted <br />April 1, 1979, and Resolution No, 47, adopted September 10, 1975, <br />be rescinded; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular meeting assemb,led in Denver, <br />Colorado, this 7th day of July, 1983, that it does hereby desig- <br />nate and approve as floodplain areas those areas described as <br />being inundated by alOO-year flood as described by the flood- <br />water surface elevations and Profiles in said new report, dated <br />March, 1983, and does hereby rescind tha.t portion of Resolution <br />Nos. 8 and 47, dated April:!., 1970, and September 10, 1975, <br />respectively; and <br /> <br />BE IT FURTHER RESOLVED that the Secretary of the Board is <br />directed to send a certified copy of this resolution to the Board <br />of County Commissioners of Boulder County; the Urban Drainage and <br />Flood Control District; the Fe~eral Emergency Management Agency; <br />and the U.S, Army Corps of Engineers, Omaha District. <br /> <br />C E R T I F I CAT E <br /> <br />I certify that the foregoing is a true and correct copy of a <br />resolution adopted by a majotity vote of the members of the <br />Colorado Water Conservation Board in regular session assembled at <br />Denver, Colorado, on the 7th day of July, 1983, at which a quorum <br />was present. <br /> <br /> <br />Secretary <br />
