(3) Between April 1 and October 15 of each year, Colorado shall not permit diversions from the lower section of the river under priority dates after June 14, 1897, that diminish the mean daily flow at the Interstate Station to less than 120 ft3/s. (4) The compact recognizes for Nebraska the "Perkins County" or "South Divide" Canal under the priority date of December 17, 1921. Nebraska would be allowed to divert up to 500 ft3/s into the canal between October 15 and April 1 of each year under the priority date with addi- tional restrictions. Colorado has a right to 35,000 acre-feet annually for future uses which would have a priority over the water reserved for the "Perkins County" Canal. The pOint of diversion of the canal, if it is ever constructed, would be southwest of Ovid, Colorado. (5) The waters of Lodgepole Creek, a tributary flowing through Nebraska and joining the South Platte in Colorado, are also apportioned by this compact. (6) The compact recogni zes that Nebraska may construct, operate, and maintain a diversion structure and canal in Colorado to serve Nebraska needs, and Colorado may obtain similar rights to construct, operate, and maintain canals extending into Nebraska necessary to serve Colorado needs, and requirements. (7) Nebraska agrees that compl i ance by Colorado wi th the compact s I provisions and the delivery of water in accordance with its terms shall rel i eve Co I orado from any further or additi onal demand or c I aim by Nebraska upon the waters of the South PI atte River within Colorado. This compact and the two decrees help to define the hydrologic system existing within the Upper Platte River Basin. It sets the stage for a discussion of major issues facing the area and the summary results of taking certain alternative steps to address these issues in the context of responding to problems, needs, and desires confronting the people and resources of the Upper Platte. 27
