<br />FPR 252 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />721 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />March 111,' 1986 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a report entitled "Flood Insurance Study, City of <br />Federal Heights, Adams County, Colorado," which includes <br />floodplain information and data for Tributary M of Niver Creek, <br />dated April 15, 1986, has been prepared by Greiner. Engineering <br />Sciences, Inc., under contract with the Federal Emergency <br />Management Agency; and <br /> <br />WHEREAS, said report describes and outlines the floodplain <br />data and information for the storw and floodwater runoff channels <br />or basins of the study area; and <br /> <br />WHEREAS, the City of Fedeial Heights has requested the <br />Colorado Water Conservation- Board to designate and approve the <br />floodplain areas as set forth in the aforesaid report; and <br /> <br />WHEREAS, <br />requires the <br />prevention of <br /> <br />Section 37-60-106( 1), Colorado Revised Statutes, <br />Colorado Water Conservation Board to assist in the' <br />floods and flood dawages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised <br />Statutes, provide that such legislative bodies of local jurisdic- <br />tions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff chJnnel or basin only after desig- <br />nation and approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(C), Colorado Revised Stat~tes, <br />directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to make <br />such designations available to legislative bodies of locai <br />jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said report and <br />does hereby recommend to the Colorado Water Conservat ion Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood) <br />as described by the floodwater surface elevations and profiles in <br />said report; <br /> <br />) <br />
