'.

,

2

Pursuant to the provisions of 5 V.S.C. 605(b), the Executive Associate Director, Mitigation Directorate,
to whom authority has been delegated by the Director of FEMA, hereby certifies that the proposed BFE
determinations, if promulgated, will not have a significant economic impact on a substantial number of
small entities. A BFE determination under Section 1363 forms the basis for new local ordinances, which,
if adopted by a community, will govern future construction within the floodplain area. By themselves, the
BFE determinations impose no restriction unless and until the community voluntarily adopts' floodplain
ordinances in accord with these BFEs. Even if ordinances are adopted in compliance with Federal
standards, the BFEs only prescribe building height in the floodplain and do not prohibit development.
Thus, this action only forms the basis for future local actions. It imposes no new requirement; of itself,
it has no economic impact.

Proposed BFEs and modified BFEs along flooding sources studied by detailed methods are shown on the
preliminary revised FlS and FIRM. Lessees and owners of real property in the City of Durango, PaPlata
County, Colorado, are encouraged to review the FIS, FIRM, and related materials at the address cited
above. The flooding sources studied by detailed methods are as follows:

Source of Flooding

Location

#Depth in feet above ground
*Elevation in feet (NGVD)
Existing Modified

Animas River

Approximately 0.67 mile downstream
Of V.S, Highway 155/160 None *6,375
Approximately 3.56 miles upstream of
32nd Street None *6,551
Approximately 1,500 feet upstream of
Confluence with Junction Creek *6,626 *6,628
Approximately 5,670 feet upstream of
Borrego Drive None *6,873
At confluence with Animas River None *6,485
Approximately 1,800 feet upstream of
confluence with Animas River None *6,513

Dry Gulch

Lightner Creek
