e

e

e

May 16,2001

Department of
Planning and Community Development

Mr. Steve L. Olsen, Director, Mitigation Division
Federal Emergency Management Agency, Region VIII
Denver Federal Center, Bnilding710, Box 25267
Denver, CO 80225-0267 .

Dear Mr. Olsen,

Attached you will find agenda documentation from the Durango City Council's public hearing Tuesday, May
15, 200 I, concerning the adoption of a revised floodplain ordinance as requl'sted by FEMA. Included in these
attaclunents is Ordinance No. 0-2001-13, "An Ordinance Repealing and Reenacting Section 10-8 of Chapter
27 of the Code of Ordinances of the City of Durango Pertaining to FloodplainStandards and Procedures and
Declaring an Effective Date." At last night's meeting, the Durango City Council did adopt said ordinance on
first reading. I had spoken with Mr. Fred Metiler last month about our timeframe, which provided for the
adoption of our revised ordinance on first reading by Ml/Y IS, with fmal reading of the ordinance scheduled for
June 5, the next scheduled Council meeting. We dis.cussed that while the City's ordinance isn't f1i1alized until
June, its adoption last night did meet FEMA's requirement that Durango adopt floodplain management
measures that satisfy the requirements of Paragraph 60.3(d) of the National FloodJnsurance Program (NFIP)
by May 21, 2001.

1ms letter constitutes the City of Durango's request that the FEMA Regional Office approve these changes to
our floodplain regulations as directed by Margaret E. Lawless, Acting Executive Associate Director for
Mitigation in the Washington D.C. office.in herletterto our Mayor dated April 20, 2001. You will note that
our ordinance contains and reflects all of the changes that Mr. Metzler identified needing to be made to our
existing floodplain ordinance in his letter to me dated January 8, 2001. I assume that you will notify Ms.
Lawless that the City of Durango has complied with the directives ofFEMA. .

I will forward you a fully executed copy of our adopted ordinance as well as the official minutes from last
night's City Council meeting which reflect the City Council's actions to adopt the ordinance as soon as they
are available from our City Clerk. In the meantime, I have attached an article from this morning's Durango
Herald that verifies that the Durango City Council did indeed approve the floodplain revisions ordinance.
Please notify me immediately you should'find anything amiss relative to the enclosed attaclunents.

~

C: Robert F. Ledger, Jr., City Manager
Fred Metzler, FEMA Program Specialist
Tom Browning, Colorado Water Conservation Board
Project File 01,043 .

Department of Planning and Community Development, Gregory 5.
