<br /> <br />require the Contractor to do the work on a force <br />account basis to be compensated in the following <br />manner: <br />(a) Labor. For all labor and foremen in direct <br />charge of the specific operations, the Con- <br />tractor shall receive the rate of wage (or <br />scale) agreed to in writing before beginning <br />work for each and every hour that the labor <br />and foremen are actually engaged in the <br />work. <br />An amount equal til67% of the above rates <br />will also be paid the Contractor to cover <br />overhead, additional bond, property damage <br />and liability insurance, worker's compen- <br />sation insurance premiums, unemployment <br />insurance contributions, and social security <br />taxes. <br />In addition to the wage plus 67% of the <br />wage, the actual amount of fringe benefits <br />will be paid to the Contractor for those work <br />classifications which carry fringe benefits <br />resulting from collective bargaining agree- <br />ments or as required by U.S. Department of <br />Labor Wage Schedules. (Fringe benefits are <br />those payments made by the Contractor to a <br />third party or trustee to cover such things as, <br />but not limited to, health and welfare, pen- <br />sions, vacations, apprenticeship programs, <br />etc.). Also the Contractor shall receive the <br />actual costs paid to, or in behalf of, workers <br />by reason of subsistence and travel allowan- <br />ces which are the result of a collective bar- <br />gaining agreement or other employment <br />contract generally applicable to the classes <br />of labor employed on the work. The 67% <br />loading factor shall not apply to fringe <br />benefits, subsistence, and travel allowances <br />paid to the workers, to a third party, or to a <br />trustee. <br />(b) Materials. For materials accepted by the <br />Engineer and incorporated in the work, the <br />Contractor shall receive the actual cost of <br />such materials, including transportation <br />charges paid by him (exclusive of machinery <br />rentals as hereinafter set forth), to which cost <br />15% will be added. <br />(c) Compensaton will be paid to the Contractor <br />for administrative expenses when all of the <br />following conditions are present: <br />(1) Extra work for which no unit bid price <br />exists, is performed on the project on a <br />force account basis. <br />(2) The work is performed by a subcon- <br />tractor or specialty firm including util- <br />ities and railroads. <br />(3) The work is not included in a contract <br />item. <br />(4) The work is not included in work that has <br />been compensated at negotiated unit <br />prices. <br /> <br />35 <br /> <br />The compensation will be a percentage of <br />the value of the work performed in accord- <br />ance with the following: <br /> <br />To $1,000 ........................... 10% <br />Over $1,000 to $10,000 . . . . $100 plus 5% of <br />excsss over $1,000 <br />Over $10,000 . . . . . . . . . . . . . $550 plus 3% of <br />excess over $10,000 <br />The percentages will be calculated after <br />certified invoices are furnished by the Con- <br />tractor. Compensation for adminstrative <br />expenses will be applied to each individual <br />billing for extra work, not to exceed one <br />billing per month. <br />(d) Equipment. For any machinery or special <br />equipment (other than small tools), the use of <br />which has been authorized by the Engineer, <br />the Contractor will be paid for the use of <br />equipment in the manner hereinafter spec- <br />ified. Rental rates will be from the current <br />edition of the Rental Rate Blue Book for <br />Construction Equipment and will be deter- <br />mined as follows: <br />Hourly rate: RR" (ADJ BB/176)(RF)(SAF) <br />+EOC <br />Standby rate: SR" (ADJ BB/176)(RF) <br />(SAF)(0.5) <br />Where: RR" Hourly rental rate <br />SR = Standby Rate <br />ADJ BB/176 = Blue Book Monthly <br />Rate adjusted for year of <br />manufacture/176 <br />RF = Regional Factor of 1.06 <br />SAF = State Adjustment Factor of <br />1.05 <br />EOC = Estimated Hourly Operating <br />Costs from Blue Book <br />OC = Ownership Costs <br />Rental of equipment not owned by the <br />Contractor will be paid for by invoice cost <br />plus operating cost (EOC). <br />(e) Miscellaneous. Additional allowance will not <br />be made for general superintendence, the use <br />of small tools, or other costs for which no <br />specific allowance is herein provided. <br />(f) Compensation. The Contractor's represent- <br />ative and the Engineer shall compare re- <br />cords of the cost of work done as ordered on a <br />force account basis to assure the costs are <br />supported and were actually incurred. <br />(g) Statements. Payment will not be made for <br />work performed on a force account basis <br />until the Contractor has furnished the <br />Engineer with triplicate itemized statements <br />of the cost of the force account work. <br />Statsments shall be accompanied and <br />supported by certified invoices for all mate- <br />rials used including transportation charges. <br />If materials used on the force account work <br />are not specifically purchased for the work <br /> <br />
