<br /> <br />previous inspections or tests were conducted by the <br />Engineer or authorized representative. <br /> <br />105.12 Removal of Unacceptable Work and <br />Unauthorized Work. Unacceptable work is work <br />that does not conform to the requirements of the <br />Contract. <br />Unacceptable work, resulting from any cause, <br />found to exist prior to the final acceptance of the <br />work, shall be removed and replaced in an acceptable <br />manner at the Contractor's expense. The fact that the <br />Engineer or an inspector may have overlooked the <br />unacceptable work shall not constitute an accept- <br />ance of any part of the work. <br />Unauthorized work is work that was done without <br />adequate lines and grades having been established <br />by the Engineer or by the Contractor, work done <br />contrary to the instructions of the Engineer,work <br />done beyond the lines shown on the plans, or extra <br />work done without the Engineer's authorization. <br />Unauthorized work will not be paid for under the <br />provisions of the Contract, and may be ordered <br />removed or replaced at the Contractor's expense. <br />If the Contractor fails to comply with any order of <br />the Engineer made under the provisions of this <br />subsection, the Engineer will have authority to order <br />unacceptable work remedied or removed an:d re- <br />placed and unauthorized work removed. The Eng- <br />ineer will deduct the costs from any monies due or to <br />become due the Contractor. <br /> <br />105.13 Load Restrictions. The Contractor <br />shall comply with all legal load restrictions in the <br />hauling of equipment or materials on public roads <br />beyond the limits of the project. A special permit will <br />not relieve the Contractor of liability for damage <br />resulting from the moving of equipment or material. <br />The operation of equipment or hauling loads <br />which cause damage to structures, the roadway or <br />any other construction will not be permitted. <br />Hauling of materials over the base course or surface <br />course under construction shall be limited to prevent <br />damage to the pavement structure. Loads will not be <br />permitted on a concrete pavement or structure be.fore <br />the expiration of the curing period. The Contractor <br />shall be responsible for the repair of all damage and <br />related expense resulting from hauling equipment <br />and construction operations. <br /> <br />105.14 Maintenance During Construction. <br />The Contractor shall maintain the project during <br />construction and until the project is accepted. This <br />maintenance shall constitute continuous and effec. <br />tive work prosecuted with adequate equipment and <br />forces so the roadway or structures are kept in <br />satisfactory condition at all times. <br />In the case of a Contract involving the placement <br />of material on or utilization of, a previously con- <br />structed subgrade, pavement structure or structure, <br />the Contractor shall maintain the previously con, <br /> <br />structed work during all construction operations. <br />All cost of maintaining the work during con- <br />struction and before the project is accepted will not <br />be paid for separately, but shall be included in the <br />work. <br />Contractors transporting material weighed by <br />Division personnel will not be given a scale ticket if <br />the load exceeds the legal limit. If a vehicle's gross <br />weight exceeds the legal limit as weighed by a <br />certified weigher and the material transported by the <br />vehicle is delivered to the project, the material and <br />the scale will not be accepted. <br />If a scale ticket from an overweight vehicle is <br />inadvertently accepted and the material incorp- <br />orated into the project, the Engineer will adjust the <br />price for the overweight load as follows: <br />(1) The pay item quantity represented by the <br />amount of material in excess of the legal weight <br />will not be paid for. <br />(2) A price reduction will be assessed for the over- <br />weight portion of the load based on the <br />following schedule. <br /> <br />Overweight <br />(pounds) <br />o 50 <br />51 3,000 <br />3,001 4,000 <br />4,001 5,000 <br />5,001 6,000 <br />6,001 7,000 <br />7,001 8,000 <br />8,001 9,000 <br />9,001 10,000 <br />Over 10,000 <br /> <br />Price Reduction <br />(dollars) <br />o <br />20 <br />40 <br />82 <br />130 <br />226 <br />376 <br />582 <br />842 <br />870 plus $164 for each <br />1,000 lbs., or fraction <br />thereof, over 10,000 lbs. <br /> <br />105.15 Failure to Maintain Roadway or <br />Structure. If the Contractor, at any time, fails to <br />comply with the provisions of subsection 105.14, the <br />Engineer will immediately notify the Contractor of <br />such non-compliance. If the Contractor fails to <br />remedy unsatisfactory maintenance within 24 hours <br />after receipt of such notice, the Engineer may imme- <br />diately proceed to maintain the project, and the <br />entire cost of this maintenance will be deducted from <br />monies due or to become due the Contractor on the <br />Contract. <br /> <br />105.16 Acceptance. <br />(a) Partial Acceptance. If at anytime during <br />the prosecution of the project the Contractor <br />satisfactorily completes a unit or portion of <br />the project, such as a structure, an inter- <br />change, or a section of road or pavement that <br />can be used ad van tageously for traffic, the <br />Engineer may make final inspection of that <br />unit.
