<br />WHEREAS. the City of Westminster and the District will <br />jointly take whatever actions are necessary. available. and <br />appropriate to assure that the flood routing capabilities of <br />the aforementioned embankments will be maintained when and if <br />the embankment or flood pool owners attempt to make changes <br />that would reduce the flood routing capabilities of the <br />embankments: and <br /> <br />'WHEREAS. the Urban Drainage and Flood Contro 1 Dis trict has <br />requested the Colorado Water Conservation Board to revise the <br />designation and approval of the floodplain areas as set forth <br />in the aforesaid new report; and <br /> <br />WHEREAS. section 37-60-106(1)(c). Colorado Revised Statutes. <br />requires the Colorado Water Conservation Board to assist in the <br />prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS. sections 31-23-301 and 30-28-111. Colorado Revised <br />Statutes. provide that legislative bodies of local <br />jurisdictions may provide z'oning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water <br />Conservation Board: and <br /> <br />WHEREAS. section 37-60-106(1) (c). Colorado Revised <br />Statuteo. diL~~L~ Lhe--Colorado Wa~er ~onservatlon Board to <br />designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative <br />bodies of local jurisdictions; and <br /> <br />WHEREAS. the hydraulic analysis contained in the said new <br />report takes into account the flood storage capabilities of the <br />C. & S. Railroad. Burlington Northern Railroad. and U.S. <br />Highway 36 embankments. which act as dams; and <br /> <br />WHEREAS. these embankments meet the requirements of the <br />Board's "Rules and Regulations for the Designation and Approval <br />of Floodplains and of Storm or Floodwater Runoff Channels in <br />Colorado" (2 CCR 408-1) for dams and their effects may <br />therefore be taken into account: and <br /> <br />WHEREAS. the said new report does not meet all of the <br />requirements for designation as detailed floodplain information <br />under the Board I s "Rules and Regulations for the Designation <br />and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1): and <br /> <br />WHEREAS. the Urban Drainage and Flood <br />requested a variance from the requirements <br />and regulations for the designation of <br />information; and <br /> <br />Control District has <br />of the sUbject rules <br />detailed floodplain <br /> <br />( <br /> <br />-2- <br />
