C. <br /> <br />Sir: <br /> <br />On behalf of the State of Colorado, and pursuant to Section I of the Act of <br />December 22, 1944 ($8 Stat. 887), there is here,vith transmitted the comments, views, <br />and recommendations of the State of Colorado concerning the proposed interim report <br />of the Chief of Engineers and the reports of the Board of Engineers for Rivers and <br />Harbors and of the District and Division Engineers, on a survey of the Arkansas <br />River, with a view to local flood protection at Pueblo, Colorado. <br /> <br />These comments. views, and recommendations are submitted under the auti'lority <br />of chapter 26S. Session Laws of Colorado of 1937 creating the Colorado Water Con- <br />servation Board and defining its functions and in accordance with the designation <br />oJ such Board by the Governor, pursuant to Section I of thE! Aot of DecE!mber 22. <br />1944 (S8 Btat.887). as the official State agE!ncy to act in such matters. ' <br /> <br />1. It is noted that the Chief of Engineers concurs in the views and recom- <br />mendations of the Board of Engineers for Rivers and Harbors. which read, in part, <br />as follows~ <br /> <br />"The Board accordingly rE!cornmends improvement of the <br />Arkansas River to provide additional local flood protection for <br />the area subject to inundation by backwater at Pueblo, Colorado,' <br />by the construction of a levee E!xtE!nding from the north abutE!ment <br />of the Santa FE! Avenue bridge to high ground adjacent to the <br />Missouri Pacific Railroad right-of-way, the levee to have a lO-foot <br />'crown width and a 2-foot cover of riprap on the river side; and a <br />drainagE! structure, with flap gatE!s, under the leveE!; generally in <br />aocordance with thE! plan of the district engineE!r and with such <br />modifications thereof as in the discretion of thE! Chief of Engineers <br />maybe advisable at an estimated cost to the United States of <br />$209,000 for construction, subject to the'provision that responsible <br />local interests give assurances satiSfactory to the Secretary of the <br />Army that they will: (a) provide without cost to the United States <br />all land, easements, ,and rights-o, f-way necessary for construction of <br />the project, when and as required; (b) hold and save the United States <br />free from damage due to the construction works; (c) protect the flood <br />oarrying capacity of the flooclway, between river miles 403 and 408, <br /> <br />" .;/J <br />
