<br />COLORADO WATER CO~SERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Co1o~ado 80203 <br /> <br />July 27, 1977 <br /> <br />RES 0 <br /> <br />L 1] T I 0 <br />- <br /> <br />N <br /> <br />WHEREAS, a flood information report entitled "Denver <br />Metropolitan Floodplain Information Report, Volume V, Ralston Creek, <br />Leyden Creek, Van Bibber Creek, Lena Gulch, Sanderson Gulch and North <br />Sanderson Creek;" dated November, 1970, has been previously prepared <br />by the U. S. Army Corps of Engineers, Omaha District; which report was <br />approved by the Colorado Water Conse~ation Board through a resolution <br />adopted on January 12, 1971; and ' <br /> <br />WHEREAS, a new floodplain information report entitled "Major <br />Drainageway Planning, Van Bibber Creek," dated March, 1977, has been <br />prepared by Gingery Associates, Inc., under contract with the Urban <br />Drainage and Flood Control District, which report updates and revises <br />the previous information proposed fo~ Van Bibber Creek by the Corps of <br />Engineers; and <br /> <br />WHEREAS, the Urban Drainage and Flood Control District has <br />requested the Colorado Water Conservation Board to designate an~ approve <br />',the floodplain areas as set forth in the said revised report for Van <br />/ Bibber Creek; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes 1973, <br />requires the Colorado Water Conservation Board to assist in the pre- <br />vention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local juris- <br />dictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel Or basin only after designation and <br />approval by the Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to make such <br />designations available to legislative bodies of local jurisdictions; <br />and <br /> <br />WHEREAS, the staff of the Board has reviewed the said revised <br />repoI't--for-Van-Bib ber-Creek-and-doe s_herehy--xecOIllJllend to ha to the-'Boar,d_, <br />designate and approve as floodplain areas those areas inundated by a <br />100-year flood (intermediate regional flood) as described by the flood- <br />water surface elevations and profiles in said revised report for Van <br />Bibber Creek; and further recOIllJllends that the floodplain designation <br />for Van Bibber Creek only as approved by the previous resolution of <br />January 12, 1971, be rescinded; <br />
